De Minimis Benefits Excluded from Taxable Income

Exclusions from Taxable Income:
Under I.R.C. § 132(a)(4), de minimis benefits—those too minor to account for—are excluded from taxable income. Examples include:

  • Employee-of-the-month parking
  • Occasional coffee, snacks, or meal money for overtime employees
  • Holiday gifts of low fair market value
  • Occasional theater or event tickets

What Doesn’t Qualify as De Minimis:
Routine or high-value benefits, like season tickets or cash equivalents, are generally taxable. Exceptions may apply if specific guidelines are followed.

Length-of-Service Awards

To qualify as non-taxable, awards must adhere to these IRS guidelines:

Qualified Awards Plan:

  1. Tax-exempt value up to $1,600.
  2. Written guidelines outlining award qualifications.
  3. Must not favor highly compensated employees.

Non-Qualified Awards:

  1. Up to $400 can be tax-exempt.

Award Criteria:

  • Awarded every five years of service.
  • Must be tangible items like plaques, watches, or golf clubs.
  • Cash, gift cards, or paid time off do not qualify.

Safety Awards:
Restricted to less than 10% of eligible employees (excluding managers and professionals) annually.
